Welcome to Direct Care Dermatology. These Terms of Service (“Terms”) govern your access to and use of the website at directcarederm.org and all related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Description of Service
Direct Care Dermatology operates a directory platform that connects patients with dermatology practices offering direct care, membership-based, or fee-for-service models outside traditional insurance billing. The Platform allows dermatology practices to create public listings and allows patients to browse and discover these practices.
We are a directory and informational resource only. We do not provide medical services, participate in the doctor-patient relationship, or make referrals.
2. Account Registration
To create a practice listing, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information during registration and in your practice listing.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activity that occurs under your account.
- Promptly update your information if it changes.
Each account is associated with a single practice. You may not create multiple accounts for the same practice or share account credentials with unauthorized individuals.
3. Practice Listings and User Content
When you create a practice listing, you retain ownership of the content you submit (text, images, logos, and other materials). By submitting content to the Platform, you grant Direct Care Dermatology a non-exclusive, royalty-free, worldwide license to display, distribute, and promote your listing content as part of the directory.
You represent and warrant that:
- All information in your listing is accurate, truthful, and not misleading.
- You have the right to submit all content included in your listing, including any images or logos.
- Your listing does not violate any applicable laws, regulations, or the rights of any third party.
We reserve the right to remove, modify, or decline to publish any listing that violates these Terms, contains inaccurate information, or is otherwise inappropriate at our sole discretion.
4. Verified Badge
Practices may apply for a verified badge, which indicates that our team has reviewed the submitted credentials and confirmed that the practice appears to be a legitimate direct care dermatology practice led by a board-certified dermatologist.
The verified badge is an editorial designation only. It does not constitute an endorsement, recommendation, or guarantee of the quality of care, outcomes, or services provided by the practice. Patients should always conduct their own due diligence when choosing a healthcare provider.
5. Prohibited Conduct
You agree not to:
- Submit false, misleading, or fraudulent information in your listing or account.
- Impersonate any person or practice, or misrepresent your affiliation with any entity.
- Use automated tools, bots, or scripts to access, scrape, or extract data from the Platform without our prior written consent.
- Interfere with or disrupt the operation of the Platform, including its servers, networks, or infrastructure.
- Use the Platform for spam, unsolicited communications, or any unlawful purpose.
- Attempt to gain unauthorized access to other users’ accounts or any non-public areas of the Platform.
6. Intellectual Property
The Platform, including its design, layout, code, text, graphics, and logos (excluding user-submitted content), is the property of Direct Care Dermatology and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purpose. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.
7. Medical Disclaimer
The Platform is a directory and informational resource only. It does not provide medical advice, diagnosis, or treatment.
No information on the Platform should be interpreted as medical advice or as a substitute for professional medical consultation. The listing of a practice in the directory does not create a doctor-patient relationship between you and any listed provider.
Patients are solely responsible for evaluating and selecting healthcare providers. We encourage you to verify credentials, read reviews from multiple sources, and consult directly with providers before making healthcare decisions.
8. Disclaimer of Warranties
The Platform is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any information provided through the Platform (including practice listings) is accurate, complete, or current.
9. Limitation of Liability
To the fullest extent permitted by law, Direct Care Dermatology, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to damages for loss of profits, data, or other intangible losses.
Our total aggregate liability for all claims arising from your use of the Platform shall not exceed the total amount of fees, if any, paid by you to Direct Care Dermatology during the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Direct Care Dermatology and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of the Platform, or any content you submit to the Platform.
11. Termination
We may suspend or terminate your account and access to the Platform at any time, with or without cause, if we believe you have violated these Terms or engaged in conduct that is harmful to the Platform or other users.
You may delete your account at any time by contacting us. Upon termination, your practice listing will be removed from the directory, and your account data will be deleted in accordance with our Privacy Policy.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which Direct Care Dermatology operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of that jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the “Last updated” date at the top of this page. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
